Rules for using our services
Welcome to Cocuy Labs. These Terms and Conditions constitute an adhesion contract under Chilean Law 19.496 on Consumer Protection. By accessing or using our website and services, you agree to be bound by these terms. Please read them carefully.

02 Description of Services
Cocuy Labs SpA develops and provides digital products and software solutions, including: the Cocuy Labs website (cocuylabs.xyz); Waitless, a digital menu platform for restaurants and food businesses; and Its a Trash, a mobile application for iOS and Android that helps users declutter their photo libraries through a swipe-based interface with AI-powered suggestions. The Its a Trash app processes all photos locally on the user's device.
03 Acceptance of Terms
By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms in accordance with Articles 3 and 12 of Chilean Law 19.496. If you do not agree, please do not use our services. These terms are available in Spanish and English; in case of discrepancy, the Spanish version shall prevail.
04 Consumer Rights
In accordance with Article 3 of Chilean Law 19.496, as a consumer you have the right to: free choice of our goods and services; truthful and timely information about the services offered, their price, conditions of sale, and other relevant characteristics; non-discrimination in the terms offered; safety in the consumption of our services; adequate compensation and reparation for damages suffered due to defects in our services; and education for responsible consumption.
05 Right of Withdrawal (Derecho a Retracto)
In accordance with Article 3 bis of Chilean Law 19.496, for any paid service contracted through electronic means, you have the right to terminate the contract unilaterally within 10 calendar days from the date of contracting the service (derecho a retracto), without the need to state a reason. To exercise this right, please contact us at hello@cocuylabs.xyz within the specified period. Upon valid exercise of this right, we will refund all amounts paid within 45 calendar days. For free services and mobile applications offered at no cost, this right of withdrawal does not apply as no payment has been made.
06 User Accounts
Some services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
07 Intellectual Property
All content, software, trademarks, and intellectual property on this website and in our applications are owned by Cocuy Labs SpA or our licensors, and are protected under Chilean Law 17.336 on Intellectual Property. You are granted a limited, non-exclusive, non-transferable license to use our services for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
08 Limitation of Liability
Cocuy Labs SpA shall be liable for direct damages caused by defects in the provision of our services, in accordance with Chilean Law 19.496. We shall not be liable for indirect or consequential damages to the extent permitted by law. Nothing in these terms excludes or limits our liability for damages caused by willful misconduct (dolo) or gross negligence (culpa grave), nor does it affect your statutory rights as a consumer under Chilean law.
09 Pricing, Payments & Refunds
All prices for our services are displayed in the applicable currency and include all applicable taxes unless otherwise stated. Payment terms are specified at the time of purchase. The total cost of any service will be clearly communicated before you complete your purchase, including any additional charges. Refund policies comply with Chilean consumer protection law, including the right of withdrawal described in these terms.
10 Termination
Either party may terminate the use of our services at any time. You may cancel your account by contacting us at hello@cocuylabs.xyz. We may suspend or terminate your access if you breach these terms, after providing notice when reasonably possible. Upon termination, your right to use the services ceases. Any data associated with your account will be handled in accordance with our Privacy Policy.
11 Governing Law & Jurisdiction
These terms are governed by the laws of the Republic of Chile, including Law 19.496 on Consumer Protection, Law 19.628 on the Protection of Private Life, and Law 17.336 on Intellectual Property. Any disputes arising from these terms shall be submitted to the jurisdiction of the ordinary courts of Santiago, Chile. Nothing in these terms limits your right to file complaints with SERNAC (Servicio Nacional del Consumidor) or to seek judicial remedies available under Chilean law.
12 Changes to Terms
We may update these terms from time to time. Any material changes will be notified to registered users via email or through a prominent notice on our website at least 30 days before they take effect. Your continued use of our services after the effective date of changes constitutes acceptance of the modified terms. If you do not agree with the changes, you may discontinue use of our services and request account deletion.
13 Dispute Resolution
If you have a complaint or dispute regarding our services, we encourage you to first contact us at hello@cocuylabs.xyz so we can attempt to resolve the matter directly. If we are unable to reach a resolution, you may file a complaint with SERNAC (www.sernac.cl) or pursue any legal remedies available to you under Chilean law. Nothing in these terms restricts your right to seek judicial resolution of any dispute.
